Illustrative situation and records to prepare

Hypothetical example; not a reported case or a predicted outcome.

An ordered appliance arrives with a different model number. Keep the listing, invoice, delivery record, photographs and seller correspondence. State what remedy is requested and its basis; the example alone does not decide consumer status, forum or entitlement.

Short answer

A consumer complaint needs a defined transaction, the problem complained of, supporting evidence and a specific remedy. First check whether you qualify as a consumer and which commission can hear the dispute under the applicable rules.

Practical preparation

  1. Collect invoices, payment records, warranty terms, advertisements, delivery records and communications with the seller or service provider.
  2. Make a dated chronology and an itemised explanation of the refund, repair, replacement or other relief requested. Keep proof of any earlier written complaint.
  3. Section 69 generally sets two years from the cause of action; a commission may allow delay for sufficient cause with recorded reasons. Confirm the starting date, current jurisdiction rules and filing requirements before submitting.

Scope and limits

Commercial-purpose exclusions and the self-employment livelihood exception need individual assessment. Do not choose a forum using outdated monetary thresholds.
