Tenant rights
- Use a written agreement and check registration and stamp-duty requirements for the term and applicable State law; the common '11-month rule' is not a complete statement of the law.
- The Model Tenancy Act's proposed residential deposit limit is not a nationwide cap; check whether a corresponding State law applies to your tenancy.
- Do not ignore an eviction notice. The required notice, grounds and forum depend on the agreement and applicable rent-control or tenancy law; a landlord must use the lawful process rather than force.
- For a threatened lockout, service disconnection or withheld deposit, preserve dated evidence and seek prompt advice from the local court or rent forum with jurisdiction.
- In Gujarat, do not assume the Model Tenancy Act or a Rent Authority process applies. Check the official text and coverage of the State rent law for the premises and tenancy before choosing a forum.
