Workplace Sexual Harassment (POSH)
The POSH Act, 2013 requires every workplace with 10+ employees to have an Internal Committee.
How to complain
- Written complaint to the Internal Committee within 3 months (extendable to 6 months).
- Workplaces with <10 employees: complain to the District Officer's Local Committee.
- Interim reliefs: transfer, up to 3 months paid leave, restrain from contact (Sec. 12).
- Inquiry must complete within 90 days; employer acts within 60 days of report.
Your protections
- Identity kept strictly confidential (Sec. 16).
- Protection from retaliation; termination during pendency is illegal.
- Applies to employees, interns, contract workers, and visitors to the workplace.
